Music Choice

      201809/1003:28

Canadian digital platform Stingray has made an unsolicited offer to buy U.S.-based TV music platform Music Choice for $120 million. The bid was presented to Music Choice's management and its consortium of owners, including cable giants Comcast, Charter and Cox, as well as EMI, Microsoft, Motorola and Sony.

The offer, which is peppered with "vendor-friendly terms and conditions" meant to smoothen a transaction with its longtime rival, is good until Aug. 31 and is currently under review by Music Choice stakeholders, the company said. Stingray was unsuccessful in its two previous attempts to buy Music Choice, in 2013 and again in 2015, but now believes it's the right time to be "joining forces."

"We believe that our formal offer to purchase has strong merit and would bring a significant return on investment for Music Choice unitholders," said Eric Boyko, president, co-founder and CEO of Stingray. "Music Choice would benefit greatly from joining forces with Stingray, given that we are well positioned to expand and build Music Choice's product portfolio and distribution in the United States and around the world. We look forward to bringing this process to a positive conclusion for the benefit Music Choice unitholders and all stakeholders."

Launched in 1987, Music Choice offers a total of 100 channels of audio/visual streams across multiple genres. The channels are known for including artist trivia, photos and facts, including song and album information for each track. Cable subscribers also have access to Music Choice's website and app, which feature simulcasts of its TV channels.

Montreal-based Stingray Digital, founded in 1997, operates several properties including the Music Choice competitor Stingray Music, which in the U.S. can be found on AT&T's U-verse service.

The two companies have long had a contentious relationship. In 2016, Music Choice took Stingray to court in a lawsuit alleging patent infringement related to the on-screen formatting of Stingray Music channels. That same year, Stingray countersued in a Texas court, claiming it was a "smear campaign" meant to weaken its growth in the U.S.

A representative from Music Choice did not immediately respond to a request for comment.
